Assessment description
A core duty of social workers supporting clients in matters relating to the law is court attendance, which often requires social workers to attend a court or tribunal session and support their clients in different roles. Social workers explain court processes to clients and help them navigate court protocols.
Most court cases are heard in an open court system as a critical approach to open justice. Therefore, the public can attend court sessions from the public gallery unless a presiding judge or magistrate orders a closed court session.
You are required to attend a local court in your area on the designated date to be announced in class. Endeavour to be on time before the court proceedings.
As you observe the proceedings, reflect on the implications of court processes and protocols for clients and your future practice as a social worker. Based on your observations, write a reflective essay and support your reflection with theoretical literature from some of our primary readings of this unit or any other relevant literature. Your reflection should cover these areas:
- In your reflective essay, demonstrate your understanding of the Australian court system and structure and the jurisdiction of the court you have observed.
- Your essay should provide an overview of the court system and identify where the court you have observed sits within the hierarchy.
- Your reflection should also demonstrate your understanding of the court processes, protocols, and courtroom interactions among various actors. Identify the key actors and their roles and power relationships,
- Discuss the subject being presented, language use, dress code, and any important artefact observed.
- Consider how a social worker would approach the issue before the court in your reflection. Refer to the core readings and any other relevant literature to support your application of social work frameworks to court processes.
- Succinctly conclude your reflection.
- Remember to list all your support references. You may use the APA referencing style.
